Terms and conditions of Deli Transilvania online food business and the products we sell:
This terms and conditions agreement is between you (‘the customer’) and T and T Trading Ltd trading as Deli Transilvania (‘Deli Transilvania’). At its sole discretion, Deli Transilvania may change or vary these terms and conditions at any time.
By visiting our website and/or purchasing something from us, you agree to and consent to abide by these terms and conditions.
Note ‘we’ refers to Deli Transilvania and ‘you’ refers to you as the customer.
Before registering with our website you must read all terms and conditions.
When registering your account all personal information (this includes name, address and email address) must be up to date and accurate.
Deli Transilvania can refuse registration of any potential client or current customer for any reason it chooses.
Any registered customer must notify Deli Transilvania of any change to its delivery address.
Deli Transilvania will use its best endeavours to prevent any unauthorised entry to its website but is not liable for any damage or loss if an unauthorised person gains access.
Deli Transilvania cannot be held responsible for incorrect information due to suppliers changing product specifications without notice to us.
Deli Transilvania may change prices of products without notice.
Deli Transilvania cannot guarantee our website will be available at all times.
We, any associates or suppliers are not liable for any loss, incident or damages that arise in connection to our website.
Deli Transilvania may elect to limit quantities of products at any time.
Payment of orders is by bank transfer only. We will process your order once we receive payment.
The confirmation email of your order you receive from Deli Transilvania shows cost of all products only without the delivery fee. This fee will be added to your invoice. The reason for this is we have varying rates of delivery based on the weight of your order.
Any costs incurred through debt collection are payable by the customer.
Costs of delivery will be as stated on your invoice.
We accept no liability for delays in delivery of our products that are beyond our control.
A product order left at a delivery address shall be regarded as being delivered from that point of time. Once delivered all risk shall pass to the customer.
When you order, please check your order as once confirmed and paid for you cannot change or cancel. If you wish to change your order you will need to go through our return policy.
Images on our website may sometimes differ in packaging appearance from that supplied.
The price of all products includes GST.
All login and password details must be kept confidential.
We will notify you if products on an order are no longer available and will either find a replacement, refund you the cost or provide a credit.
Credits must be used within 6 months.
We reserve the right to and ownership of all intellectual property of Deli Transilvania. This includes business name, designs, trademarks, logos, brand features and anything else associated with or attributed to our business.
Trademarks on our website have been used with the permission of the appropriate third party.
We do not warrant that the quality of any products will meet your expectations or that any errors in our supply to you will be corrected. However, we will always meet our obligations under the Fair Trading Act and the Consumers Guarantees Act.
Deli Transilvania has no obligation in respect of or liability for advice provided and any products delivered to you. Once delivered, all products shall be at your sole risk and must be used for their intended purpose.
As a registered customer of Deli Transilvania, you agree that we may collect, access, correct and/or use any personal information provided by you until such time as you may choose to de-register with us.
Should we sell our business, you agree that we may pass all personal information collected from you to the new proprietor of the business.
You agree that we may publish information voluntarily provided by you to us in the form of testimonials, photographs, product ideas and the like at any time.
We warrant that we will at all times extend the utmost respect to our customers. In particular, if a product is damaged, charged incorrectly or not delivered, we will refund the value of that product or provide a credit as appropriate.
These terms and conditions shall be governed and construed in accordance with the laws of New Zealand.
